Terms of service

1. Who we are
The PuntPulse website and service (the “Service”) is run by PuntPulse Pty Ltd (ABN 76 703 627 230), trading as PuntPulse (“we”, “us”). You can contact us at hello@puntpulse.com.
2. Accepting these Terms
By using the Service, or by creating an account, you agree to these Terms and to our Privacy policy. If you don't agree, please don't use the Service.
- You must be 18 or over. The Service is about betting on racing and is not for anyone under 18.
- If you have excluded yourself from gambling (for example through BetStop), or you're worried about your gambling, please don't use the Service — see Responsible gambling.
- The details you give us, including your email, must be accurate.
3. What the Service is — and isn't
The Service publishes statistical estimates of greyhound and horse race outcomes made by computer models (“ratings”), the prices bookmakers and betting exchanges are offering, the gap between the two, and calculators (such as a Kelly staking calculator) that work on numbers you enter.
- Ratings are estimates and are often wrong. They are not tips, recommendations, betting advice or financial advice, and nothing on the Service is an inducement to bet.
- We do not claim, and have not shown, that the models beat the market or that following them makes a profit. Words such as “edge”, “value” or “fair price” describe the model's own estimate compared with a price, not a proven advantage. Backtests and past results don't predict future results.
- Whether to bet, what to bet on and how much is entirely your decision.
- We are not a bookmaker or wagering service, we don't take bets, and we aren't affiliated with any bookmaker, betting exchange or racing authority.
4. Accuracy and availability
Race fields, results, form and prices come from third parties and can be wrong, late, incomplete or out of date — including late scratchings and price changes right up to the jump. Always check the price and the field with your bookmaker before you bet. The Service may sometimes be unavailable, a race may not be rated, and we may change, add or remove features. If a change removes something a paid plan includes, section 6 applies.
5. Accounts
- Keep your login details secure. Accounts are for one person and aren't to be shared.
- You can close your account at any time by emailing us.
6. Paid plans
These terms apply to paid plans. The price and renewal terms are also shown to you before you pay. Payments are processed by Stripe.
- Plans are billed in advance, in Australian dollars, either monthly or yearly — you choose when you subscribe. A yearly plan is one payment for 12 months. We're not registered for GST, so no GST is charged. You'll get a receipt for each payment.
- A plan renews automatically at the end of each billing period (every month, or every year on a yearly plan) until you cancel. You can cancel at any time from your account page. Cancelling stops the next renewal, and you keep access until the end of the period you've already paid for.
- Free trial. Your first monthly plan may start with a free trial (the length is shown before you subscribe). We take your card details when the trial starts but don't charge you during it. We'll email you a few days before it ends. Unless you cancel before the trial ends, the plan's monthly price is charged on the day it ends and every month after until you cancel. Cancel during the trial and you won't be charged at all. One free trial per person; yearly plans don't include one.
- You can move from monthly to yearly billing, or up to a higher plan, from your account page. The price difference for the rest of your current period is worked out for you and shown before you confirm.
- If we change a plan's price, we'll email you at least 30 days before it applies to you. It applies from your next renewal after that notice, and you can cancel before then.
- If we remove a significant feature of your plan, or end your plan when you haven't breached these Terms, we'll tell you and refund the unused part of any period you've paid for.
- Otherwise we don't refund part of a billing period — a part-month, or the unused months of a yearly plan you cancel — but this never limits your rights under the Australian Consumer Law (section 7).
7. Your consumer rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or changes those guarantees, or any other right or remedy you have under the Australian Consumer Law or any other law that can't be excluded — including a refund or other remedy for a major failure.
8. Responsibility for bets and our liability
You are responsible for any bet you place, and for any loss on it. Subject to section 7, and to the extent the law allows, we are not liable for any betting loss, or for any loss caused by data that was wrong, late or missing, or by the Service being unavailable.
9. Acceptable use
Use the Service for your own personal, non-commercial purposes. Don't copy, scrape, resell or republish its ratings or data, share your account, try to get around access limits, or interfere with or reverse-engineer the Service. We may suspend or close an account that seriously or repeatedly breaches these Terms; where it's reasonable to, we'll tell you first and give you a chance to fix it.
10. Intellectual property
The Service's content, ratings and software belong to us or our licensors. Racing data and prices belong to their providers. Bookmaker and racing names are trade marks of their owners and are used only to identify them.
11. Our own betting
People involved in running PuntPulse may bet, including on races the Service rates.
12. Changes to these Terms
We may update these Terms. If a change could disadvantage you, we'll tell you by email or on the site at least 30 days before it takes effect. If you don't agree with it you can close your account or cancel your plan before then, and we'll refund any unused part of a period you've paid for. The “last updated” date above shows when they last changed.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. This doesn't take away any right you have to bring a claim under the Australian Consumer Law where you live.
